However, texting behind the wheel is illegal in most U.S. states and regulators note FSD is a driverâassistance system that still requires full attention. Safety agencies are already scrutinising Teslaâs claims.

Musk told AWS re:Invent attendees that Teslaâs new FSD v14.2.1 now lets drivers âtext and drive,â claiming the system can better understand surrounding traffic. The remark drew strong criticism for appearing to endorse an illegal and unsafe behavior.
Texting while driving is banned in nearly all U.S. states, and many also forbid any handheld phone use. Muskâs comment raises legal and safety concerns, especially because FSD is not autonomous and cannot replace human attention.
FSD is still a Level-2 driver-assistance system, meaning the driver must stay fully alert, keep hands on the wheel, and be ready to intervene at any moment. Tesla uses cameras and sensors to monitor attentiveness and can disable FSD if the driver seems distracted.
Regulators are already investigating Tesla, including NHTSAâs probe into crashes tied to FSD and the California DMVâs accusations that Tesla misled consumers about autonomy, scrutiny that could slow future approvals in the U.S. and internationally.
